Lost in all the Constitutional arguments about Presidential power is the fact illegal aliens who broke our laws could collect large government checks under the IRS’s Earned Income Tax Credit which sends money to lower income workers based on income and number of claimed dependents. Call it President Obama’s New Year’s gift for illegal immigrants.
And checks could be retroactive.
As explained by Obama aides, newly amnestied illegal immigrants will sign up for the tax rolls. However, illegal immigrants are likely to be low wage workers who won’t pay much in tax but will get money back from the Earned Income Tax Credit.
Here are the facts noted by the Daily Caller . “Illegal immigrants will receive huge payments from American taxpayers under rules now being imposed by President Barack Obama’s unilateral amnesty.
The illegals will get work-permits and Social Security cards, and will be required to pay taxes, according to Cecilia Munoz, the former immigration lobbyist who is now a top Obama aide.
That means they’re part of the tax system, she said, when she was asked if the illegals would get annual payments under the Earned Income Tax Credit program.
“They are subject to our tax law,” she said, carefully.
Most households of illegals have very low income, and pay little in taxes. For example, in 2011, roughly 22 percent of immigrant households — both legal and illegal — were classified as living in poverty. In contrast, only 13 percent of American households were in poverty.
However, once illegal immigrants are enrolled in the tax system, they would be entitled to EITC payments.
The payments may be huge, and will rise each year.
According to the Internal Revenue Service, two parents with three or more children would receive up to $6,143 in 2014 if they earn less than $46,997.
And Frontpage Magazine reports the benefits could be retroactive once the illegal immigrants get a valid Social Security card. “And the party is just getting started because we’ll be paying them retroactive welfare benefits.
On June 9, 2000, a “Chief Counsel Advice” was published in the name of “Mary Oppenheimer, Acting Assistant Chief Counsel (Employee Benefits)”, though it was signed by “Mark Schwimmer, Senior Technician Reviewer”. This document advises IRS employees that illegal aliens who are disqualified from receiving the EITC can retroactively receive EITC benefits for years worked without a valid Social Security number if, after receiving a valid Social Security number, they file an amended return for the previous years worked.
Thus, illegal aliens who obtain legal work authorization, either by qualifying for a work visa or by dispensation granted by Congress or the immigration authorities, and who then obtain a valid Social Security number, can claim the EITC for previous years worked without a Social Security number as long as such claims are not barred by a statute of limitations, generally within three years.”
